Viva Web Marketing Software Products Terms and Conditions
1. Free Trial
Viva Web Marketing offers a 14-day free trial for new users.
A valid credit or debit card must be on file to initiate the trial.
2. Billing and Payments
The billing cycle starts on the day after the 14-day free trial ends.
The card on file will be charged on a monthly basis.
All subscriptions automatically renew for the same period unless terminated prior to the renewal date.
A 30-day cancellation notice is required to terminate the subscription.
3. Customer Service Responsibility
Clients are responsible for handling any customer service issues that arise from using our software.
4. Payment Processing
Clients may opt to use VivaWeb Marketing’s payment processing service ("VivaWeb Payments") to handle customer payments via credit/debit card or ACH, subject to approval.
Usage of VivaWeb Payments entails certain fees disclosed at the time of sign-up.
VivaWeb Payments may utilize third-party processors, currently Stripe, and users agree to abide by the Stripe Services Agreement and Stripe Connected Account Agreement.
VivaWeb Marketing is not liable for the acts or omissions of any third-party payment processors.
5. Intellectual Property and Website Content
Clients must purchase their own domain through a third-party provider if they wish to build a website on our platform.
If VivaWeb Marketing builds the website, we own the domain and the site. Customer data can be requested at any time.
A hosting fee of $29 per month applies to all websites.
VivaWeb Marketing makes no guarantees regarding search rankings for websites built on our platform.
Clients are responsible for ensuring their domain name and content do not infringe on third-party rights. VivaWeb Marketing may remove websites that infringe on such rights at its sole discretion.
6. SMS Notification, Chat, and Phone Number
Clients may need to add a company-specific phone number for an additional charge if included in their subscription.
Notifications will be sent to customers from the provided phone number, with clients responsible for obtaining necessary consents from message recipients.
VivaWeb Marketing is not liable for any issues arising from these communications and clients must indemnify VivaWeb Marketing from any related claims.
7. Phone Number Transferability
Company-specific phone numbers may not be transferable.
These phone numbers will be held for 90 days after subscription cancellation.
8. Restrictions and Limitations
VivaWeb Marketing reserves the right to suspend or deactivate phone number functionality in cases of suspected misuse.
9. Limitations of Liability
VivaWeb Marketing, its officers, directors, affiliates, employees, and agents are not liable for any damages arising from the use of the service, under any legal theory.
This includes direct, indirect, punitive, incidental, general, special, or consequential damages.
Liability for lost data resulting from the service operation is expressly disclaimed.
The aggregate liability of VivaWeb Marketing is limited to the total fees paid by the client in the previous six months.
10. Termination of Account
This agreement remains in effect while using the service and survives termination.
Clients can terminate their account by emailing [email protected], with the account being disabled within 14 days
No refunds are provided for subscription fees unless explicitly stated.
VivaWeb Marketing may terminate accounts at any time, with or without cause, by notifying the client via email.
Reasons for termination are at the sole discretion of VivaWeb Marketing and may not be disclosed.
Upon account termination, VivaWeb Marketing may retain client information but is not obligated to do so.
Refunds for canceled paid accounts are generally issued within 14 days of the cancellation request.
